Wanted for Murder: Antonin Scalia

Antonin Scalia is guilty of initiating the theft of the 2000 election from Al Gore through a stay he issued forcing the stop of the State Court ordered recount in Florida, and his subsequent coordination a 5-4 majority to annoint George W. Bush as President.

But as of just yesterday, August 17th, he also added state sanctioned murder to his list of crimes.

Scalia was one of just two written dissenters (along with his puppet, Clarence Thomas), who ferociously challenged the notion that the Supreme Court should ensure that an innocent man not be put to death.  That's right, Scalia -- in common sense terms and not the legal mumble jumble that he dazzles the likes of Harry Reid with (BuzzFlash once wrote an editorial about how Harry Reid thought Scalia so brilliant he might consider voting for him for Chief Justice at the time -- such is the sad mindset of our Democratic Majority Leader) -- asserts that there is nothing in the Constitution that prevents an innocent person from being executed.

No, we are not making this up. Scalia -- although he uses arcane justifications of state vs. federal jurisdiction and that tidy trials shouldn't be challenged -- argues that the governmental legal system is not prohibited by the federal Constitution from killing the wrong person, in the name of -- excuse me while I throw up a little in my mouth -- "justice."

BuzzFlash will let Scalia speak for himself in his dissent of the appeal for lower court review of the highly questionable conviction of high profile death row inmate Troy Anthony Davis. Says Scalia in his dissent (which also bears the name of Clarence Thomas):

The Georgia Supreme Court rejected petitioner’s “actual-innocence” claim on the merits, denying his extraor-dinary motion for a new trial. Davis can obtain relief only if that determination was contrary to, or an unreasonable application of, “clearly established Federal law, as determined by the Supreme Court of the United States.” It most assuredly was not. This Court has never held that the Constitution forbids the execution of a convicted defendant who has had a full and fair trial but is later able to convince a habeas court that he is “actually” innocent. Quite to the contrary, we have repeatedly left that question unresolved, while expressing considerable doubt that any claim based on alleged “actual innocence” is constitutionally cognizable.

People like Harry Reid are just so damn impressed by phrases like "constitutionally cognizable" -- no wonder the Democrats almost always pull defeat out of the jaws of victory in the Senate.

But back to Mr. Scalia. A legal website noted:

The Supreme Court, over two Justices’ dissents, on Monday ordered a federal judge in Georgia to consider and rule on the claim of innocence in the murder case against Troy Anthony Davis (In re Davis, 08-1443)  The Court told the District Court to “receive testimony and make findings of fact as to whether evidence that could have been obtained at the time of trial clearly establishes [Davis'] innocence.”

In short, if attorney for Troy Anthony Davis can establish his innocence, he should be freed not put to death. Makes sense, right? Not for Mr. Scalia (or Mr. Thomas).

They have a lot of posh parties and social gatherings in D.C., and the powerful ruling class exchange bon mots and try to dazzle their fellow D.C. elites with their brainpower.  Scalia is known to impress people with his ability to bring a legal argument to such a high clould level of wordy claptrap that people don't know what he is talking about and mistake his gift of hubris and pugnacious verbal bravado for genius.

But, every person must be responsible for his or her actions -- that is what the law is all about, isn't it? -- and when it comes down to Scalia as a man, he's just an accessory to murder wearing a black robe.

Tried by a D.C. jury, the guy would do less harm to the nation and innocent Americans if he were put behind bars himself.

Antonin Scalia

Frankly, I think it is high time that We the People re-think some of the offices that are protected by either gubernatorial appointment or lifetime terms. I have long thought (since the Anita Hill debacle that put Long Dong Silver into our highest court in the land... what a joke!) that the life appointments to the Supreme Court should be converted to terms in office and put to a public vote. The Rehnquist court was a nightmare of travesty and Antonin Scalia's opinions and voting record clearly point out the corruption and other sick thinking this country is plagued with by the Neo-Con Right. If the Supreme Court cannot carry out its intended duties in the light of right reasoning, if the Supreme Court has become little more than a rubber stamp for corruption; if not directly complicit, then it is past time to do something about it. There is no real reason for not having Scalia charged, and site him for abuse of power and outright murder where appropriate. No one should be above the law, especially a Supreme. We the People want no more thugs running any branch of our government, nor should a lifetime appointment be an impediment to prosecution.

Scalia = The Complete Downfall Of Justice!

If this latest arrogant, twisted use of the Constituion doesn't reveal what a complete (I would use a word here but I don't want to insult fatherless children) Scalia is, look back to his vote against Lily Ledbetter (she was supposed to know about her unequal pay over many years, even though it was kept secret!) If this is the thinking of a Supreme Court justice what hope is there for the entire justice system? And as was mentioned, his unashamed presidential give-away to Bush (and look where that madness led us - the whole world in disarray!). But there he sits, smug and self-satisfied, leading his lap dog "Uncle" Thomas to follow his EVERY vote. They would umndoubtedly have voted against allowing mixed marriages in which case Thomas could not have married his white wife! They're both against affirmative action - in which case Thomas probably wouldn't have even risen to the mediocre judge he was. They both, along with the two liars, Roberts & Alito ("I vow I won't let my own views influence my vote.") They have voted with the corporation over the individual in EVERY instance, even defying precidence to become "activist judges"! The Supreme Court used to have a place of honor in the minds of the populace - NO MORE - it's now more of a joke! (If it wasn't so damn sad!)

Scalia --a warped mind in action,

-and it comes from his church orientation, the concept being that a 'devine decision' is final. A decision thus made cannot be questioned or the falability of the church is exposed. What can be more 'devine' than the ascent to the Supreme Court? after all it took the church 500 years to 'forgive' Galaleo! This concept explains the 'Family' of politicians who believe that there winning political success has to be 'devine', how else can such basically stupid and morally flawed indiduals be elected? What can be more 'devine' than the rise to the SCOTUS? Scalia forgets, for his own pleasure, that decisions by lower courts can be appealed and reversed so the SCOTUS has to be given a 'devine' title. To that end there is no 'innocence' -- and Scalia, Thomas and all who support them can float off on their magic carpet to that place in the sky where there is no "air". Without "air" Scalia will be silenced for eternity, a pleasurable thought.

Impeach!

I think the five "justices" (I use that term loosely) that stopped the Florida recount in 2000 should be impeached. The fact that the "Democratic" (I use that term loosely too) majority hasn't, reveals their complicity in the corruption.

The Democrats need some competition from an uncorrupted party like the Green Party, that doesn't accept corporate money, and that actually stands for something (http://www.gp.org/tenkey.shtml).

Insanity

Since he doesn't believe in "actual innocence" (or in his case, not!!) is a good enough defense, and belongs to Opus Dei which is the weirdest religious sect that totally believes in and loves suffering, and he helped unleashed the Bush nightmare,.... yes, let's impeach, imprison etc. and throw away the key. And NOT in one of the "fancy" prisons. Then he could live out his own rulings.... perfect.

Scalia ~ mass murderer

Is it any surprise that Scalia is a murderer? He put into office one of the biggest group of mass murderers in the history of the world. And Harry Reid, that idiot. I am a Democrat, but as Senate majority leader he is beyond milquetoast, he is a moron. He bends over for every wisp of smoke from the Repugs when we were a minority but is still doing the same thing when we are a freaking majority fer gawd's sake! Now that I know he thinks Scalia is the cat's meow, it pretty much cuts it and proves his lack of ~ shall we say, intelligence? This case is living proof (or dying proof for this innocent man) that the entire Supreme court needs to be massively mooned. Just have thousands of people stand in front of the Supreme Court and at the count of ten, turn around and moon them to show the disrespect and disgust we have for them. I will reserve judgment on our newest appointee for now, but ... to be frank I am not holding my breath about her either. Cat in Seattle >^..^<

Reid

I knew that Harry Reid was a milquetoast but until I learned his opinion of Scalia I hadn't realized he was a complete dimwit. It certainly doesn't take a legal scholar to see that Scalia's views on this case, his views on conflict of interest, state's rights and a number of other issues are warped to the point of incompatibility with the Constitution and current American values. It certainly doesn't speak well of the Democratic Party that Reid has risen, or floated, to the top of the Senate as Majority Leader.

Justice

The "justice" system of the United States of America has been murdering people since 1789, and, suddenly, it's wrong? Capitalists need their profits, and those who get in the way will be murdered one way or the other.
