Dave Lindorff: Ward Churchill Victory Update

A Colorado TV station is reporting that interviews with some of the six jurors in the unfair dismissal court case filed by University of Colorado Professor and Native American activist Ward Churchill against the university reveal that five of the six wanted to award him $150,000 in damages after establishing unanimously that he had been improperly dismissed by the school.

Reportedly one lone juror held out for a minimal $1 symbolic award and ultimately, because they "wanted to go home," the rest of the jurors conceded the point.

Churchill, who claimed that the case was "not about money" but about vindicating his claim that he had been hounded out of his job because of his political views, hailed the verdict as a victory, because the jury decided that he had in fact been fired for political reasons, and that charges of plagiarism and fraud in his scholarship were unsubstantiated.

The significance of the $1 damage judgement is that it now enables Churchill to petition the court to order the university to pay his legal costs, which are estimated to reach $1 million.

The university, through a public relations spokesperson, had claimed when the verdict against it was announced, that the jury had offered the school "some vindication" by limiting the damages to a token amount, but the new report suggests that it was actually only one juror who was offering that partial "vindication." The five others apparently thought the university owed Churchill significant damages.

" ... Native American activist ..."

Most people who pretend to be Native Americans, including the majority of registered members in federally recognized Indian Tribes, have far more non-Indian ancestry than actual Native American forebearers ......... and Ward Churchill has none at all.

That would not matter a whit if not for the privileged status such a scant genetic connection to this continent's aboriginal inhabitants bestows under US law.

Curious how quousque seems to blame the victims of genocide for allegdly now having a smaller amount of their Native American ancestors' genes than he deems proper...

The whole notion of registered members was imposed by the US Government, adhering to the racists principles of the Founding Fathers, as carried forward by the dominant racist elite who now find themselves in a demographic bind as so many Latin American immigrants with strong percentages of Native ancestry continue to come into the country.

Native cultures have long had mechanisms for adopting children and adults into their group, no matter what their DNA might be. It is the genocidal conquerors who decided this had no validity. We should remember that Hitler had a great admiration for US Native policy since his party firmly believed in the primacy of blood.

As for Ward, how do you know he has no Native ancestry? What is your proof? And should it make a difference?

As for the privileged status, please. What about all the millions the Interior Dept has stolen and continues to steal? Their interested mismanagement has earned them many contrary judicial rulings but they have yet to fork over the dollars owed and continue under Obama to deny their responsibility. That's change?
