Steven Jonas: The Bush War on Iran, the US Constitution, and the UN Charter

Is there a reporter brave enough to ask the following question at the Daily Tony Snow Job White House Press Briefing?
"Time magazine and many international sources have reported a major US air-sea build-up in the Persian Gulf and the Arabian Sea, in preparation for a US assault on Iran which is considered to be imminent. When is the President planning to call Congress back into session to ask for a Declaration of War, which he will need, under Section 8, Article I of the Constitution, in order to proceed?"
The "international sources" mentioned in the proposed question above include Time, "What the War with Iran Would Look Like" (9/25/06), and those appearing in the extensive reference list (85 of them in fact) of "The March to War," by M.D. Nazemroaya, (Global Research, 10/1/06). The Global Research article presents a lengthy, detailed analysis of the plans for the BushWar on Iran. Laid out is a very frightening scenario of what the Georgites are planning for the Iranian people, the people of the Middle East generally, the people of the US, possibly the people of Central Asia and Europe, and indeed even of the whole world. The (totally human-manufactured) Armageddon envisioned by the political core of the Georgites in the United States (as well as by certain Jewish and Muslim extremists, and, possibly, by Bush himself) may well be upon us. Yes, we could be facing the Georgite solution to the looming disaster of global warming: the use nuclear weapons in Iran which could well lead to nuclear winter.
However, we aren't there yet. There are certain steps that the anti-Bush political forces in the United States could take to avert the war (beginning with trying to find a reporter with White House press credentials brave enough to ask the question suggested above). Or at least they could publicly warn Bush and the Republicans of the very serious consequences for him and his Party that could well result if he were to undertake the invasion, whether or not he were to use nuclear weapons. (The latter assumes of course that civilization in general and the United States as a sovereign country would survive such a catastrophe.) Mass popular eruptions there would certainly be in the US. Anticipating them in the case of an Iran Attack (obviously well into preparation at this point) may be one reason why Bush pushed so hard for the passage of the US Enabling Act. He could, and likely would, respond with mass round-ups of demonstrators, with indefinite imprisonment without recourse to any element of due process. Whether the Democratic Party, the few sane elected Republicans left, the increasing number of elements of the US power elite that are totally opposed to Bush, and other US political forces, would be able to pull themselves together in a coalition to mount an effective political and legislative campaign against the Georgites is another matter. (Even James A. Baker, III, the man who more than anyone put Bush in the White House in 2000, may be joining the group of the US power elite that wants Bush out: "G.O.P.'s Baker Hints Iraq Plan Needs Change," David Sanger, The New York Times, October 9, 2006.) However, the US Constitution gives them the tools to do so.
Under Article I, Section 8, the Congress has the exclusive power to declare war. The Georgites and their Privatized Ministry of Propaganda would surely make the case that such an invasion is covered under the War Powers Act or the "fighting terrorism" resolution. However, no matter what real or imagined or created-out-of whole-cloth "evidence" they would present, the present Iranian posture vis-à-vis uranium enrichment could not in any way be characterized as an "emergency" or an "immediate threat" of any kind.
The Georgites themselves are the best source of this: they claim only that Iran, in continuing with its refinement of nuclear fuels, is aiming towards building a bomb. Should the President, facing this reality, send US forces into war on his own, that is clearly an impeachable offense. Going to War in this manner is also a clear breach of Articles 33, 34, 37 and 51 of the United Nations Charter which, according to Article VI of the Constitution, constitute "the supreme law of the land." He could be impeached for that violation as well. (If he does invade, it would be interesting to see which countries might try to invoke Articles 39 and 40 of the UN Charter against the United States in the Security Council.)
How could this be done in a practical manner, given a) that the Congress is in the hands of the Republicans, b) that the Congress is in recess until after the election, c) that Bush would most likely claim that under the US Enabling Act, which gives him the power to over-ride on his own authority most of the Articles of the Constitution and the key elements of the Bill of Rights? Not easily. He used a vague "Iraq is a danger and we have to do something about it" resolution to justify his full-scale invasion of that country. He would likely say that since Congress granted him the authority to ignore broad swathes of the Constitution already, he could then ignore any others, like the power to declare war, he wanted to.
Although given an invasion of Iran, the first concern must be for the people of Iran and the second for our own safety given such an outlandish event, the third would be that we would have a full-blown Constitutional crisis on our hands. And so, what would/should the opposition forces do?
A) Demand the emergency reconvening of Congress to 1) call the Republicans' bluff by introducing a Declaration of War resolution to the Senate (having determined in advance that at the worst a filibuster would prevent its passage), 2) demand the immediate institution of impeachment proceedings in the House.
B) Facing the likelihood of a Republican refusal to reconvene, the Democrats, and any Republican allies they might be able to scrape up, especially if Bush does this horrendous thing before the election, would have to call a rump session of Congress, possibly outside of Washington, to do "A" above.
C) Mount a massive mass/news-media counter offensive against the Privatized Ministry of Propaganda.
D) Mobilize whatever military leadership they could find, especially among the active flag-officer class willing to risk their careers by coming out against the war, possibly even refusing to serve in it, on the basis that it would be un-Constitutionally declared.
E) Take their case to the UN, through the large number of member nations that would be opposed.
F) START NOW, RIGHT NOW! The Georgites must be very publicly asked, in a variety of forums, about the Georgites intentions and exactly what the military preparations in the Arabian Sea and the Persian Gulf mean.
Well, that's it for now, my friends. I don't pray, but those of you who do, please do. As for me, I hope that wiser heads, with power, will prevail, either before or after the catastrophe we face were to occur. For if they don't, it may well be that, for one reason or another, there will not be too many more of these columns following.

Bush's Mental Instability As Grounds For Removal
The easiest way to remove Bush from office is to declare him to be mentally unstable, which would be totally accurate. He regularly demonstrates that he's completely disconnected from reality. If I remember correctly, under the 25th Amendment of the U.S. Constitution, the President of the United States can be removed from office for being unfit to hold office.
The Joint Chiefs of Staff should be considering this as an option. If they allow Bush to attack Iran, Russia and China will retaliate with nuclear weapons. This is not a tenable situation.
Friends of mine have been telling me for a long time that Bush and his entire cabinet are crazy, but I didn't really believe that. Now I do. I think they're mentally ill and should not be holding any public office.
We really have to hope that the U.S. military won't obey orders to attack Iran. But, what worries me is a scenario in which the Bush crew uses mercinaries disguised as Iranians to attack U.S. forces in the Persian Gulf.
From what I've heard, U.S. battle ships are slated to arrive in the vicinity of Iran on or around October 21, 2006. I hope the U.S. generals have the brains and the balls to thwart any effort by the Bush Administration to start another unprovoked war.

I have no doubt W has serious psychological issues. That said, these policies are so insane (detainee bill, staying the course in Iraq, preemptively nuking Iran) that they must have more support than we are led to believe. Meaning, there must be an explanation as to why Congress and MSM stand around like morons as the Bush administration ruins America and gets closer to plunging the entire planet into another World War (of course this time around several countries have nukes).
Then again, maybe there is no grand explanation. Maybe our "leaders" have simply signed on for policies of depopulation and war profiteering. It says a lot about the character of our so called leaders that not one single person has resigned in protest.
It's coming
If we were talking about rational people we wouldn't be talking about attacking Iran. The people in power are not rational, they're not even close to being sane.
There is no way that bush&co will be held accountable for the crimes they've committed. Accountablibity isn't even in their vocabulary. I have no doubt that we're going to bomb Iran to take people's minds off the house of cards that are falling down around the republican party. It will be the old "rally around the flag" one more time.
And know this - what's about to happen will make all that's happened before it seem trivial. There will soon come a time when things will get so bad that not even the most ignorant will be able to ignore and when mass demostrations come about the 800+ detention camps that Haliburton and KB&R have built will be filled. Elections will be suspended or so corrupted as to be meaningless (if not already so). bush - with the dictorial powers now granted him with the passage of the disgraceful Military Commissions Act can now complete the neo-cons destruction of this once great nation.
We are no longer the home of the "free" - it remains to see if we're still the home of the "brave".
Let The Mass Protests Begin
True, they didn't help to prevent the Iraq war, but the stakes are even higher now, since we're talking about a nuclear winter. And by the time our president reconvenes Congress, it'll already have started because nothing is easier for our military than instigating a war - "We launched our missiles at 1000 sites in Iran after their radar locked on our airplanes and ships, so they started it and not us" yeah, sure), and who's going to challenge that statement, especially when our soldiers and sailors already are in combat? Remember, they got away with this story before, most notably in our attack on Libya two decades ago.
What good our protests? Maybe little to none but at least we will have tried. It's possible too, that if there are enough of us (millions of people in America as well as throughout the world), a few cowardly lion Democrats will find their hearts and join us in demanding that our president call off his Iran war. What's even more crucial, we've got to win the November election, and big! Can we do it? We have to, since the alternative is to stay the course towards the dead-end straight ahead.
Mass Distraction
Consider the implications of the following:
1. The Folly suprise hits the media one full month before the November elections.
2. The source of the disclosure are republican affiliates.
3. The Republicans, as a defense blame Democrates for sitting on the emails and text messages for political reasons.
4. Further disclosures come out in the next few weeks, ensuring that no far reaching conclusion can be made because more infromation is still coming out. This means that because of ongoing investigations, the only thing we know for sure is that Folly is guilty, and he has already been removed from office. Hassert may be next, but the damage to the party will be minimal because the damage will be slowly controlled. Hassert knows he is a gonner, but as a loyalist, he is slowing down the party descent by staying in there.
5. All the while North Korea has tested a nuclear bomb on George Bush's watch, with little public outcry about his lack of leadership.
6. Torture has been legalized without outcry.
7. Redefining who can be called terroists slips under the radar.
8. Carl Rove's office is directly tied to Jack Abramhoff, and an aid is forced to leave his office, and not a peep out of the media about it.
9. The Esenhower is deployed to Iran.
10. Neocons look like they will be loosing grip on the power they worked for twenty-five years to hold.
11. 9/11 Conspiracy theories are statrting to take hold in the public's mind with no offical way to confront it except through dismissal and name calling.
12. Dick Cheney's connection with Haliburton is alive and well, and part of his entire plan to maintain power and control for the forseeable future.
Now, do you really think the disclosure of Tom Folly's diddles is a coincidence, or a gift from the Gods? This is a planned psyops to keep people focused on the left hand, while the right hand seals the deal and we are in an unretractable war that nobody wanted, draft eminant.

This nothing new. Goggle USS Liberty
Pres. Johnson ordered the sinking of the USS Liberty by Isreal while stationed 14 miles off Eygtian coast in a deal that would of blamed whatever Arab/Muslim country of their chosing, allowing the U.S. to enter the conflict. This is one of the most covered-up Black Ops/False Falg operations ever committed by the United States. Being that this plan is under operation now doesn't surprise me at all.
Iran has super topedeos supplied to them by Russia that our ships currently have no defense against. bush, deploying our ships off the Iranian coast puts them within range of these deadly weapons.
