High Noon for Justice and the Rule of Law
A BUZZFLASH EDITORIAL
It's the iconic American Western of one man taking a stand for justice and the rule of law. It's his wedding day to a beautiful, pacifist younger bride (Grace Kelly) -- and his last day as marshal in a frontier town. Gary Cooper (the laconic, lanky marshal) could leave right then to start a family, and set up a new comfortable life as a store owner.
Some interpret "High Noon" (nominated for seven Academy Awards) as a 1952 allegory of principled defiance against the era of McCarthyism, which foreshadowed the courage of Edward R. Murrow in being a lone man with the bravery to challenge and bring down the thuggish, immoral senator from Wisconsin.

"High Noon" -- Sometimes You Can't Run Away from Upholding Justice
Murrow's historical March 9, 1954 broadcast began the unraveling of the reign of uncorroborated witch-hunting, anti-Communist fear (and a watershed moment for broadcast journalism in America): "Our working thesis tonight is this question: If this fight against Communism is made a fight against America’s two great political parties, the American people know that one of those parties will be destroyed and the Republic cannot endure very long as a one party system. We applaud that statement and we think Senator McCarthy ought to. He said it, seventeen months ago in Milwaukee."
It was a brilliant maneuver to hoist the drunken master of intimidation by his own petard. Murrow, like Marshal Will Kane (Cooper) in "High Noon," was taking on someone who had subdued a nation (as the Miller gang did in "High Noon's" Hadleyville) with the assertion of raw power not subject to the restraint of truth, due process, justice, or the law.
Murrow closed his opening salvo against McCarthy with this statement: "The actions of the junior Senator from Wisconsin have caused alarm and dismay amongst our allies abroad, and given considerable comfort to our enemies. And whose fault is that? Not really his. He didn't create this situation of fear; he merely exploited it -- and rather successfully. Cassius was right. 'The fault, dear Brutus, is not in our stars, but in ourselves.'"
In that sense, Murrow was also speaking of the residents of the frontier town of Hadleyville in "High Noon." Because on the day of Marshal Kane's (Cooper) wedding and retirement, four killers were returning to avenge the conviction and imprisonment of their leader, just released, who had terrorized the town some years earlier until Kane had arrested and convicted the gang's leader for murder.
Kane wasn't looking for trouble, but when Hadleyville was again faced with the violation of the rule of law, Kane couldn't flee, despite his young bride's desire to avoid a confrontation.
There are some situations, Kane reasoned, when lawlessness shoves itself in your face -- and you have to confront it head on, not run away cowering.
The people of Hadleyville, for one reason or another relating to cowardice and profiteering from the past crime sprees of the outlaws, refuse to assist Kane in battling the criminals, as their leader rides into town on the late morning train.
Kane is left to himself to confront them -- and with the unexpected assistance of his young Quaker wife, survives the "High Noon" shootout.
The rule of law prevails.
Such is, if we stretch this analogy, the situation in Washington.
There is no need anymore to investigate the Bush Adminsitration. Their chronic defiance of the rule of law -- even the legal requirements that they themselves have set up -- their defiance of the Constitution, their failure to implement laws passed by Congress, their perjury, their contempt for justice, their effort to subvert the voting system in the United States, their prosecution of a war based on lies -- these and so many more reasons compel the impeachment of Dick Cheney, George W. Bush, and Alberto Gonzales.
The Democrats in Congress may not have the votes to prevail. (The Republicans will have to decide whether they stand up for America or stand with a cabal of crooks.) But, in their lack of effective action, the Democrats are condoning the violation of our nation's most basic governmental glue: the Constitution and the rule of law.
Gary Cooper (Marshal Kane) wasn't looking for a confrontation on the day of his marriage and retirement; it came to him -- and he knew what he had to do.
What sort of standard are we setting for any American if we allow this administration to continue to so brazenly defy laws and offer us nonsense as an excuse for their illegal behavior? What do we tell defendants? What do we tell our children? That ridiculous and absurd excuses for criminal behavior will be acceptable, and will allow the perpetrators to go free?
Because that is what Congress is permitting the Bush Administration to get away with. The final descent into some sort of absurdist pit of law-breaking and bold defiance of the Constitution -- not to mention the threat to our national security -- is Dick Cheney's claim that he does not have to abide by national security guidelines for handling confidential documents because he is not a member of the Executive Branch. When you have attained this level of unaccountable tragic farce, the American system of reasoned government has already become unglued.
Like the residents of Hadleyville, Congress can continue to retreat in endless babble from confronting the lawlessness that has landed on their and our doorsteps. But they do so at grave risk to the foundations of our democracy.
Simply put, unless we have a Marshal Kane to come to our rescue, or unless the Democratic leaders of Congress realize that although they didn't ask for criminal behavior in the Executive Branch to fall down upon them like a thunderstorm, it has -- and they have no choice but to face up to their Constitutional obligations to pursue the removal from office of those who continue to openly, defiantly, and mockingly break the law. Unless such leadership emerges, the fabric of our democracy will unravel.
To avoid such a stand is to cede our country to those individuals who make a mockery of its legal system and Constitutional foundation.
It is to tell present and future generations that the rule of law can be defied with impunity.
This is not a question of Capitol Hill vote counting; it is a question of whether we are going to continue to collectively accept that our legal system holds people accountable for their behavior.
If not, let's stop pretending that we are a nation of laws, based on the precepts of a Constitution.
The Democrats are not responsible for the actions of this rogue, criminal executive branch; but they are responsible for meeting it head on at "High Noon."

Being that we either end the Iraq war or it'll be the end of us. Fortunately for us what we need do, troops out now, not only is a no-brainer, it'll be a snap, since most of us, according to the latest poll (see headlines), not only are opposed to the Iraq war, we consider it to be morally wrong. How to start the ball rolling? We bombard Congress with emails demanding that it stop funding the Iraq war, that's how. Oh, what good is that gonna do? Change the world, that's what.

As former members of the armed services of the United States of America, we swore to support and defend the Constitution of the United States against all enemies, foreign and domestic. Upon discharge from service we did not renounce that oath, which remains our sacred duty.
It has long been apparent to us that our Constitution is under attack and has been deliberately and relentlessly undermined by domestic enemies – indeed, by our highest government officials who took and have violated that same oath.
Many Constitutional crimes have been committed by the Bush administration, including warrantless electronic surveillance of American citizens in violation of the 4th Amendment, failure to provide due process rights in violation of the 5th and 6th Amendments, infliction of cruel and unusual punishments in violation of the 8th Amendment, usurpation of powers granted exclusively to Congress in violation of Article I, Section 1, and violation of Article VI, Paragraph 2, which states that all international treaties to which the United States is a signatory are “the Supreme law of the Land.”
The wars prosecuted by the Bush administration in our name with our national resources are violations of all treaties defining the international laws of war since 1928, including the United Nations and Nuremberg charters, which uniformly prohibit wars of aggression. As violations of these international covenants and pledges, they also constitute high crimes against the United States Constitution.
Furthermore, the illegal occupations of Iraq and Afghanistan and other war crimes including torture and use of internationally prohibited weapons such as depleted uranium, violate the Geneva Conventions of 1949, thereby further violating the Supreme Law of our Land.
Our oath therefore compels us to issue a citizens’ warrant for the immediate arrest of George W. Bush and Richard Cheney, President and Vice-President of the United States.
We call upon President Bush and Vice-President Cheney to surrender themselves to federal law enforcement authorities or to any private group of Americans that is prepared to make these citizens arrests.
The right of citizens arrest is deeply grounded in English common law and is constitutionally protected under the 9th Amendment, derived from the natural right of self-defense and defense of others. A citizens arrest is valid when arresting citizens have a reasonable belief that the suspect has committed a felony.
We believe that felonies of great magnitude have been committed, and the evidentiary bases of these are conclusively established in the public record.
We charge these officials with conspiracy to commit genocide against the citizens of another sovereign state, with conspiracy to commit mass murder of American citizens by waging a fraudulently justified war, and other high crimes described on our website, www.VeteransAgainstTorture.com.
Our charges include war crimes and crimes against humanity for which we will seek extradition for trial in the international criminal court at the Hague, Netherlands, following trial in the United States for treason and other high crimes against our constitutional government.

Impeach the bastards!
The House HAS the votes for Impeachment. All it takes is a simple majority to pass the Articles of Impeachment and pass it to the Senate for trial and the Dems have that "simple majority"
Of course there is no way in hell they will get the votes out of the Senate to find them guilty and remove them from office but nevertheless Bush and Cheney will be branded as IMPEACHED forever in history.
At this point in time, I think a hell of a lot of us would settle for that. I know I would.
On the other hand...
Impeachment doesn't mean so much, now that the Republicans have cheapened it.
Besides, every day GWB spends in power is another nail in the Republican coffin.
Why do you think the GOP impeached Clinton?
While I'd like to see the president and vice president impeached, tried and convicted of high crimes and misdemeanors, you're right, the Republicans cheapened and subverted the Constitution with the three-ring sexual circus of the Clinton impeachment.

Not matter how difficult it may seem. No matter how impossible they tell us it is, we need to push forward. Impeachment is right because it IS right!

I'd call calling Christine Todd a liar to her face and getting her to sing about Rudy in a hearing "meeting the rogues head on."
Your editorials ought to be browbeating the MSM, because pressure has to come from the public (you have a large readership but I mean the mainstream public) for their reps to impeach the bastards out of there. ESPECIALLY the thugs have to be pressured or the media will turn it into a bullshit "partisan" circus. You know, just like NPR did about Cheney's declaration of independence from the executive branch...they called it a DEM concern!
Where were your screaming headlines about NPR, calling them out? You should be more concerned about your OWN High Noon, Buzzer. Confront your own...how is the larger public going to know what your readership knows when even NPR drops the ball?
The thugs want to ride it out and call the dems "cowards" and "do nothings" --- it's part of their 2008 strategy, all written out --- so, as long as the Dems' nonstop investigations bring nothing to light because the media's busy covering Paris Hilton, all that our whining and carping about OUR OWN is going to accomplish is THEIR goals. THIS is what I call DO-NOTHING when more than ever the Dems need back-up and trumpeting of everything they ARE doing. Apparently, the Dems live in the real world, unlike Buzzflash and Buzzflashians, and like the Wild West heros, they know you can't put the cart in FRONT of the horse, because the cart can't pull the horse.

It's Time -but the D's are without honor or humanity
We are the American Imperial Hegemony with over 1000 bases spread over 103 countries - and nothing about this state of affairs seems to rile the electorate or bother the representatives.
During debate on the 2008 Foreign Operations bill, the House approved by voice vote an amendment submitted by Iowa Republican Rep. Steve King that inserted the word “permanent” before “basing rights agreement” in the following text:
“SEC. 685. None of the funds made available in this Act may be used by the
Government of the United States to enter into a basing rights agreement between
the United States and Iraq.”
As King has pointed out in the past, the United States has never had a “permanent” basing rights agreement with any country where, like Germany, Japan, and South Korea, Washington has based troops for decades. So the amendment, if it becomes law, means that the administration may now use funds to enter into any kind of basing rights agreement with the government of Iraq that it wishes.
Obviously, where the legislative branch cares enough to fund Hegemony - the Unitary Executive becomes secondary to building an empire. The voice of Democrats was absent -even to the limited degree to exercise their right to demand a RECORDED VOTE.

How about the R's, since they are the ones withholding their votes and cynically riding out the public's ignorance while the progressives eat their own. How about placing blame on and hounding only the party responsible? Go on, go outside in the sunshine and see how many people on the street follow Buzzflash and even KNOW half of this stuff.
Buzzflash and Buzzflashians continue to think they need to send the Dems a "message" (but HATE, whine and throw a FIT when any like "message" is sent to them), when the game plan ought to MIRROR thug tactics instead of AIDING thug tactics. The plan ought to be hounding and ridiculing every thug from your brother-in-law to those in office. We ought to stick together and stop attacking our own since it's the thugs who preach letter of the law and personal responsibility while flouting both.

Personally, I don't want to "stick together" with a Democratic politician who lies and insults my intelligence. Example: It's all the Iraqis fault for not "standing up".
