Weigh in on accountability vs. moving on -- Will prosecution pay dividends, or simply distract from a positive agenda and desire for unity?
George Stephanopoulis asked VP-elect Joe Biden Sunday if Donald Rumsfeld and others should be prosecuted for their role in allowing torture, or "prisoner abuse," at Abu Ghraib, Guantanamo, and elsewhere. Earlier in the week, Senator Carl Levin and the Senate Armed Services Committee concluded that the decisions of Defense Secretary Donald Rumsfeld and other high-level Bush administration officials led to that abuse. Biden said:
"President-elect Obama and I are not sitting thinking about the past. We're focusing on the future."
Biden argued it's up to the Justice Department, under Attorney General-designate Eric Holder, to determine whether the case should be reviewed.
"I'm not ruling it in and not ruling it out. I just think we should look forward. I think we should be looking forward, not backwards," Biden said.
During the campaign Obama had said:
“What I would want to do is to have my Justice Department and my Attorney General immediately review the information that's already there and to find out are there inquiries that need to be pursued,” Obama told journalist Will Bunch. [Philly.com, April 14, 2008]
Obama also said:
“I would not want my first term consumed by what was perceived on the part of Republicans as a partisan witch hunt because I think we've got too many problems we've got to solve.”
Back in the Nineties, President Bill Clinton, of course, also backed off from prosecuting members of the George H.W. Bush administration who were implicated in Iran-Contra and arms for hostages deal-making. Clinton's explanation of that, given in his autobiography My Life, was:
... that he “disagreed with the [Iran-Contra] pardons [by Bush 41] and could have made more of them but didn’t.” Clinton cited several reasons for giving his predecessor a pass. “I wanted the country to be more united, not more divided, even if that split would be to my political advantage,” Clinton wrote.

Is there a lesson here for the incoming Democratic Obama/Biden administration? Can "looking to the future" bring unity? What happens if Democrats play nice and move on? What happens if they don't? Will Eric Holder make it through confirmation to become the attorney general who wages the war of accountability -- despite the GOP's intent, voiced by Karl Rove, to stall or block his appointment?

On the question of justice for Bush and his co-conspirators, the verdict was, "All signs point to No."
Support for Bush and his co-conspirators is, it must be remembered, fully a quarter of the adult population. But that number is deceptive. It comprises a huge majority of the most wealthy and powerful individuals in the country, the very same people who enjoy a stranglehold on the political process in Washington, if not elections this time around. Some cheerfully refer to them as "The Establishment."
The general popular outrage against Bush and his co-conspirators, coupled with what my Magic 8 Ball predicts, suggests that our current governing arrangements may leave something to be desired.
I could be wrong, of course.

Hitler was the greatest mass murderer of all time for political reasons.
Dubya/dick were and still are the greatest mass murderers for wealth alone.
For that they should be tried for war crimes, and if/when found guilty, sentenced to be hung by their chicken-hawk necks until dead.
Then we need to confiscate all the billions of dollars they stole, no matter where in the world the money is hidden, including Dubai.

"Ex-Canuck" is exactly right: the phrasing conveys the message.
If prosecution of Bush administration officials is termed a "witch hunt", then you can be sure that those using that term don't "get" the seriousness of what's transpired, or they're running scared from the likely outcome.
Even Buzzflash's own phrasing of this post's title: "Should Obama Play Nice, or Prosecute?" basically says that ignoring Bush administration criminality is "playing nice", therefore prosecution is "playing nasty". This thinking is backward: ignoring criminal acts, or even giving criminals the now-customary wrist-slap, sends the message that such behavior is just fine, or will at worst be winked at.
Ignoring crimes promotes "nasty play".
Prosecution of criminal administrations - i.e. upholding the Constitution - is, in fact, "playing nice".

"Robust" prosecution is required under the Constitution.
