All 41 Senate Republicans Seek Veto Power Over Obama's Federal Judicial Appointments. Stop the Obstruction; End the Filibuster.

A letter signed by all 41 Senate Republicans was sent to the White House and Senate Judiciary Committee Chair Patrick Leahy yesterday in which the GOP demanded inclusion in, and ultimately veto power over, the confirmation of the president's judicial nominees.

The demand was a sharp turn-around for Republicans, who had for the past eight years been calling for the swift confirmation of then-President George W. Bush's appointees.

The letter is couched in historical language, which notes that "our Democratic colleagues have emphasized [senate involvement in appointments] for several years" and "the principle of senatorial consultation (or senatorial courtesy) is  rooted in this special responsibility, and its application dates to the Administration of George Washington." But the GOP's request for veto power of nominees before the judiciary even debates a particular appointment is far from the norm.

The letter gives lip service to themes of bipartisanship, saying they "look forward to working with" the president and that "the judicial appointments process has become needlessly acrimonious." However, what they demand is nothing short of minority control. The letter states that if Republicans "are not consulted on, and approve of, a nominee from our states" they will "not support moving forward," presumably threatening a filibuster.

The phrase "senatorial courtesy" may sound better than "threat of filibuster," but as Politico points out, "the letter is an opening salvo in what could be a partisan battle in the Obama years." The public perception of the use of filibusters is perhaps reflected in this language of bipartisanship that insists upon senatorial courtesy "regardless of party affiliation." The letter emphasizes the idea of working together, when the true intent is more threat than peace offering.

The GOP's determination to oppose Obama's judicial appointments became clear a little more than a week after the 44th president was elected. As we reported back in November, Sen. Jon Kyl (R-AZ) pledged to get his colleagues onboard an aggressive filibuster campaign against what he termed "radical leftist" nominees he feared would come out of this new White House.

Yet, back in 2005, Kyl was firmly on the opposite side of this argument:

"This is strictly about whether or not a minority of senators is going to prevent the president from being able to name and get confirmed judges that he chooses after he's been elected by the American people."

In fact, the recent past offers many instances in which conservatives attempted to shame Democrats into abandoning filibuster rights in judicial appointments. The "senatorial consultation" referred to in the letter, also known as the "advice and consent" clause in the Constitution, was argued by supporters of Bush to mean that the Senate's role was to confirm or deny appointees, not offer advice. It appears White House Counsel Gregory Craig has begun his outreach to Republicans in the Senate over judicial appointees, but it is unclear whether the plan outlined in the GOP Conference letter will affect the nomination process.

Kathryn Kolbert, president of People For the American Way, told BuzzFlash that the White House should not be swayed.

"The letter is so blatantly hypocritical and baseless that it should not be taken seriously by the White House," she said.

Further, the striking of a bipartisan pose when it comes to the American judicial system is a new idea for Republicans. As Michael Greco, past president of the American Bar Association, and Patricia Wald, a former chief judge of the United States Court of Appeals for the District of Columbia Circuit, pointed out in an October 2008 op-ed:

The Bush presidency has produced a right-wing judicial imbalance... Barack Obama has a different view of the role of judges from that of Bush and McCain. Obama, a Constitutional scholar, would likely appoint judges who respect the Constitution as he does -- particularly its core values of liberty and equality. Unlike Bush -- who dangerously has used "presidential signing statements" to decline to enforce new laws he does not like, thereby unconstitutionally usurping power from both Congress and courts -- Obama would ensure that courts safeguard the freedom of all citizens, independent from political influence of the executive branch and Congress.

A request for a comment from Leahy's office was not returned by press time. However, he released this statement in 2004 addressing Republican complaints over Democrats' supposed unwillingness to confirm controversial Bush appointees:

To put it charitably, these crocodile tears about judicial nominations are a tad disingenuous.  

Let's review the record.

The earlier Democratic-led Senate confirmed more Bush judicial nominees than the Republican-led Senate has. In all, Democrats have joined in confirming 173 Bush judicial nominees -- 100 of them during the Democratic-led Senate.

So 173 have been confirmed. Six controversial nominees have been blocked. Two of them have been unilaterally appointed by the President during Senate recesses.  One has withdrawn to rejoin a lucrative job with a law firm. That leaves three who have been blocked. One-hundred-seventy-three confirmed, to three blocked. Compare that to the more than 60 Clinton judicial nominees who Republicans blocked from even getting hearings, let alone votes.

Reid needs to step down

Senator Harry Reid is ineffectual, spineless, and in over his head. For the good of the country Reid needs to stop thinking of himself, recognize that he does not have the aptitude to be the Senate Majority Leader and step down. If Senator Reid does not step down I will do whatever I can to get this man UN-elected.....He is in the wrong position at the wrong time. We need a competent, fair majority leader....not an incompetent Reid. The neocons must adore Harry Reid. I'd love to see someone like Senator Feingold as the majority leader....that would be awesome!!

Remember When...

...the Republicans were the Congressional majority? The Democrats were left cooling their heels in the hallways while the GOP shoved a lot of bad bills at Bill Clinton, who then signed them under some mistaken idea that the GOP output represented the will of the people.

But now that the GOP is in the minority, these crybaby losers seem to think that a similar payback for the outrage above isn't going to apply to them. Luckily for them, Obama has better things to do than to play Payback's A Bitch with them. He has tried (mistakenly, IMHO) to include them in decision-making, but they spit on his hand to infect Obama with political AIDS after they bit him hard and deep.

Our Constitution protects minority rights, but it does not mandate them to be dominant. If the GOP members behave, they might just get a couple of their troglodytes named to some obscure Red State benches where the people don't care about justice anyway. But for the rest of us, they lost and they can follow the advice they gave us after SCOTUS awarded them what they hadn't won - and they can like it or lump it!

Give the GOP the same voice they gave the Democrats after 1994 and end the filibuster as it is currently configured.

Remember when....

I don't believe it is reasonable to assume that Democrats are going to be in the majority in the Senate indefinately, for many, many years. (Although, of course, I would wish and hope they could be....but....not likely)....therefore, I want the option of a filibuster available to my minority party. I WANT them to be able to stand up and talk for days on end in order to try and defeat some pernicious bill the Republicans are about to pass. I want them to be able to STOP the whole process in it's tracks when some Republican President and some Republican majority wants to pass some bill that it utterly against all our principles and beliefs. And, for God's sakes, I WANT the Democrats to REQUIRE the Republicans to stand in the well of the Senate for days on end trying to stop President Obama's policies while ALL the rest of the country WANTS the President's policies to be enacted. I want to WIN politically for a very long time and requiring the Republicans to put their mouths where their threats (of a filibuster) are is the way to do it. Right quick.

The Dems NEVER used it

What filibuster? The Dems NEVER used it! Not for "unitary executive"-loving Alito. Not for torture. Not for domestic spying. Not for the war. What the hell were they ever planning on using it for? What good is a "weapon" if you agree to never use it, which is what the Dems did?

Dems never used it

I've heard it said that the Ds are suffering from battered wife syndrome. Ugly, but I've come to understand that this is the likely explanation. Nothing else makes sense. They've got the White House with a current occupant who wants to sign what they send him. They've got big majorities in both houses of congress. The Rs knew how to play a a hand like that. The Ds bend over with their pants around their ankles and mutter "bipartisanship" and "reach across the aisle." Then the Rs say, hey, you didn't take our dictation, you weren't bipartisan. The country isn't buying it, but will the Ds get a clue? Or a spine? Will they nominate and approve a liberal answer to Alito and make it stick, THE WAY THE OTHER SIDE DID? Don't hold your breath.

Exactly. Problem is, do you remember the last time the Dems actually did that? Did they filibuster Mukasey? Or Gonzo? Or the re-up of the Patriot Act? Or the Military Commissions Act? Or........... Do YOU remember when the Ds were actually holding up outrageous judicial nominations? And the Rebooblicans were threatening the NUCLEAR OPTION (meaning eliminating the filibuster)? And the Ds caved? In case you're forgetful, in exchange for not losing the right to filibuster, the Ds agreed to not use it except "in extreme circumstances." Whatever that means. And they never used it again. Beyond pathetic. That's how we got Alito and Roberts for the next 30 years. Nothing has changed since then. Every single time the Rs say boo, it's like a cattle stampede as Pelosi and Reid rush to cop out. The difference between them and the Rs is the Rs know how to fight and win. The Ds know how to cave. That's it. And if they don't grow a spine "right quick," we're going to be treated to the spectacle of having the Rs dictate who Ginsburg's replacement will be--and you won't like it.

Anonymous I could not agree more. It seems many of the supporters of the current majority in the house and senate have forgotten the cowardly craven ways of the democrats. They acted like the republicans would actually do bodily harm if the stood up for the American people and our Constitution. I don't believe I can ever forgive them for their actions, non actions even when they gained power in 2006. What a bunch of wimp asses! Thats the problem we have today in the halls of congress. The republicans know the democrats will cave if they put enough pressure on them. It doesn't matter if they have the majority and the support of the American people. They have and will cave. Thirty five percent of unneeded tax cuts in the stimulas package is proof they will concede on every issue if the republicans say BOO! They claim Pelosi and Reid are tough and are walking the walk. Time to trot out the Nuclear Option again--only from OUR side of the aisle. If the Rs like bare knuckles so much, give them a face full. The Rs weren't interested in bipartisanship back in the DeLay days when Ds never saw a bill until the day it was to be voted on, or votes were taken in the middle of the night when the Ds were home in bed. Or the vote was held open for hours until Delay and Hastert could twist enough arms and make enough threats about primary challenges to Rs who were threatening to break ranks. Or when Hastert was telling the Ds don't bother proposing amendments because they'll never make it out of committee. Now they whine about the need for bipartisanship, which they only get interested in when they lose an election. Are the D memories that short? Can't they grow a spine? When are they going to show the Rs that two can play that game? When are the Ds going to start demanding up or down votes on nominations and clean bills, the way the Rs did? It's time to remind them who won last time around (THEY DID!), and get down to kicking some serious Rebooblican ass! We sent them in to do a job! They need to start fighting! And by the way, when was the last time you saw Harry Reid actually make the Repugs carry out their filibuster threat? I mean, make them stay up all night filibustering against the SCHIP bill, while Democrats went nationwide telling the country that the wingnuts were staying up all night so they could deny sick kids the right to get the care they need? When have you seen something like that? Really? Me neither.

Remember when...

I've come to the conclusion that the filibuster has got to go. Only one party is willing to use it, and boy have they! On every single issue of any consequence, the Reboobs have required a 60-vote majority for passage. Since the Dummocrats are not willing to give the Rs tit for tat, we now have "minority rules" in the Senate. It would be nice to see someone--anyone--on that side of the aisle grow some balls.

Republicans lost

Not only are Republicans the sorest losers of all time, they are the sorest WINNERS. They are pathological and are NOT going to go away. Not only that, they are very dangerous to us, personally AND politically, and we take our eye off of them at our peril. It is fun and relieving for us to call them names, of course, but, name-calling is THEIR specialty. We will do better by mobilizing our voters into contacting our Congress and our President and letting all of them know where the political winds are now blowing. We cannot just sit back and wait for Obama to do his job all on his own. WE, who put him in office, MUST pick ourselves up from our Inaugeral euphoria and get back to work supporting him. Calls and letters don't work anymore sorry to say. Millions of calls, letters and petitions were made to the democrats the last eight year expressing the will and concerns of the American people but the democrats proved they were more afraid of the republicans than their constituents. They did not win one single fight and they had more votes than the republicans do today in the congress. They could have stopped and or changed one hell of a lot of the criminal policies of the Bush Administration but were too cowardly to stand up and be counted. The republicans know they will regain power one day! Their sanctimonious actions prove this point. History proves them right. The voters will reinstate them to be sure. Nuclear Option

The Democrats need to do (but won't, because they're too timid) what the Republicans threatened to do: use the nuclear option. Either lower the filibuster limit to, say, 55, or do away with it entirely. Enough bullshit, and let's get on with things.

Filibuster

What I do not get is that they never filibuster, they just threaten to filibuster and the democrats usually cave in. Why not force them to filibuster? If the depiction of filibuster in movies is correct, that means a senator will speak and speak and speak. If that is true, let them, it will make news, and the public pressure will mount. What was absurd last 2 years is the record number of filibusters by the republicans while the public did not even know.

I absolutely agree! Why should Democrats give up their right to filibuster, come the day they are again in the minority, just because Democrats right NOW refuse to make the Republicans do it? For some unfathomable, to me, reason Democrats REFUSE to make the Republicans filibuster. If they WOULD do that, and marry that to their image of Rush Limbaugh being the new Republican Party's leader, they would crush, I tell you, crush the Republicans.

Make the Republicans stand up and speak 24/7 so the citizens of this country and the world can see who is obstructing government. Not just judicial appointments but other legislation as well. There is a chance nothing will be accomplished for almost 2 years but moderate Republican voters might get the idea that the conservative right of their party, about 38 senators, are unreasonable. That should help the Democratic majority in the Senate get to 60+.

I Can't Agree With This

It was a disgusting idea when the Right wanted to do it to us six years ago - and it's no less disgusting an idea when BuzzFlash is proposing it.

I say, rather, that we should all urge Reid to let the Republicans filibuster to their hearts' content - put the onus for halting the saving of our economy and the rescue of our society squarely onto Republican shoulders! Or has everybody forgotten already just how well "shutting down the US Government" worked for Newt Gingrich back when he was Speaker of the House? I recollect it was such a capstone to his political career that he hasn't held an elective position in over a decade, and his influence is currently limited to writing bilious op-eds calling for the destruction of the Bill of Rights - when he's not co-writing mediocre SF novels....

Let them filibuster just as it was meant to be. Stalling progress until the public's mind has been changed to reflect the view point of the decent idea. They have NO ideas and NO decency. Let them portray themselves as just what they are. Obstructionist sore losers, who will continue to destroy our America. Let the nation see how their bankrupt morality, has bankrupted us financially and morally throughout the world. Let them drill the final hole in their rotten corrupted sinking ship............. Yes, we begged for it--AND DIDN'T GET IT! When the Ds had the chance to filibuster they caved instead. That's why we have Alito now, and Bybee, and it's how we got Gonzo and Addington and Roberts. this analogy. you are comparing a legislative maneuver where the senate president of a democratic republic can break a tie vote to a political judge running a people's kangaroo court in a totalitarian state. Furthermore, filibusters are not mandated by the Constitution, but only by senate rules. Why wouldn't liberals want "that" kind of power (whatever "that" is)when considering the abuse Republican Party power has wrought upon this country. Why should they not be denied the power to govern from a minority position or to obstruct sound governance by the majority in keeping with popular sovereignty? Liberals should not fear power, only the very type of power Freisler and the Republican Party represent. If the Democrats do not exercise power, the Prepublicans will.

the same balance the Democratic Party took advantage of when the Republicans held roughly the same-sized majority in Congress about six years ago - remember? The Democratic Party is not going to be in power forever, any more than the Republican Party was - and on the day that happens, you'll all be glad enough that the filibuster rule exists, believe me!

Until then - let the Republicans filibuster. Don't cave to their demands - they're so hot to filibuster? Let them filibuster - while President Obama with his 80% approval rating is gently reminding the American People that he'd really like to get on with the business of government, but there's this Republican reading the Washington, DC phone directory, or Ann Coulter's latest hatefest into the Congressional Record and preventing Congress from doing its job, see.... ;)

We agree, if...

The Ds will start making the Rs stay up all night reading out the phone book while the Ds make hash of them on the Sunday talk shows. So far, no sign of that. They wilt at the first threat of a filibuster. And if that's going to be their pathetic game plan, then get rid of the filibuster. Failing to use it is nothing more than unilateral surrender. Find a way to make them use it and you've got me.
