U.S. quits as observer at UN Human Rights Council under war-crimes accusations

The White House quietly pulled out of the UN Human Rights Council as the Bush Administration came under fire by the House of Representatives for possible war crimes violations. Separately, Guantanamo Bay prosecutors prepare for their own war-crimes tribunals and secret negotiations continue over the role of the U.S. in Iraq.

In his daily briefing Friday, State Department spokesman Sean McCormack answered questions about the U.S. relinquishing its observer status in the international council. He criticized the institution as "pathetic," and "almost solely focused on bashing Israel." Though McCormack said the U.S. intends to "take a more reserved approach" in its participation, Reuters reported rumors that the U.S. will soon "disengage totally" from the council.

The 47-member council addresses human rights violations worldwide. It was created in 2006 to replace the UN Commission on Human Rights, which had been criticized for granting membership to countries with poor human rights records, such as China and Sudan. The U.S. voted against its creation and has since refused to become a seated member, though it remained an involved observer until the announcement this weekend.

The same day as the announcement from the State Department, 56 members of the House of Representatives called for an investigation into the possibility that the Bush Administration may have committed war crimes in its advocacy for more intense interrogation techniques against detainees.

In a letter to Attorney General Michael Mukasey, the congressmen called for the appointment of a special counsel to investigate President Bush, his cabinet and others for having "systematically implemented, from the top down, detainee interrogation policies that constitute torture."

The lawmakers who signed the letter include the House Judiciary Committee Chair Rep. John Conyers (D-MI) and Rep. Jan Schakowsky (D-IL) of the House Select Committee on Intelligence.

Adding to the perception that harsh interrogation techniques are acceptable to the Bush Administration, a military defense lawyer said a standard operating procedures manual instructs interrogators at Guantanamo Bay to destroy evidence, including notes on how confessions were obtained.

The lawyer for Omar Khadr, Lt. Cmdr. William Kuebler, quoted the manual in an affidavit released Sunday. He said the directive will figure in his client's defense, which is expected to be among the earliest to be heard in the first U.S. war-crimes tribunal since World War II.

Last Thursday, journalist Patrick Cockburn reported details of a "secret plan" by the Bush Administration that were recently leaked to the British newspaper The Independent. He said the long-term agreement currently being negotiated between the U.S. and Iraqi governments, which President Bush said he will not submit for Congressional approval, would establish permanent bases in Iraq and extend the occupation indefinitely.

However, human rights watchdogs may be more concerned with the provision protecting U.S. troops and contractors, both of whom have been implicated in human rights scandals in that country, from criminal prosecution.

"American negotiators are also demanding immunity from Iraqi law for U.S. troops and contractors, and a free hand to carry out arrests and conduct military activities in Iraq without consulting the Baghdad government," Cockburn wrote.

The key to criminal immunity

The key to criminal immunity is to be more powerful than the criminal justice system, or to involve so many people in committing the crime that a majority are guilty. The latter strategy is often used by the Republicans, and certainly was in the war against the Iraqi people. Few in Congress do not deserve a fate worse than hanging. (I suggest life in chains at hard labor cleaning up the mess in Iraq.)

War Crimes Trials

Any nation signatory to the Geneva Conventions may try accused war criminals. It doesn't need to go to The Hague. The Republican-led Congress passed legislation in 1996 that designated severe penalties including death for the crimes that Bush, Cheney, etal have committed in violation of our standing treaties under the Constitution. A chief prosecutor of Nazi war crimes at Nuremberg, US attorney Benjamin Ferencz, has said George W. Bush should be tried for war crimes along with Saddam Hussein. He secured convictions for 22 Nazi officers for their work in orchestrating the death squads that killed more than 1 million people. "Nuremberg declared that aggressive war is the supreme international crime," and pointed out that the United Nations charter, which was written after the carnage of World War II, contains a provision that no nation can use armed force without the permission of the UN Security Council. Ferencz also observed that after Nuremberg the international community realized that every war results in violations by both sides, meaning the primary objective should be preventing any war from occurring in the first place and that the atrocities of the Iraq war were highly predictable at the start of the war. If they violated the Constitution it is treason and they should be tried for treason. We are way beyond impeachment.

Don't count on it.

There is nothing that could warm my heart like a good old fashioned war crimes trial with our fearless leaders in the docket, but I don't expect to see it. The Democrats, even if they win the White House and overwhelming majorities in both houses of Congress, do not have the stomach for it. Nor, I suspect, do the American public, although it would be a hell of lot more interesting than "American Idol."

You're so naive

If you think Democrats need a a larger majority to make Bush accountable, you live in a fantasy world. Democrats have been Bush's co-conspirators for 7 years now and he would NOT have gotten away with so many crimes if Democrats had not been behind him 100%. In fact Democrats never needed a majority to stop Bush, they had at least 40 senators for every second of his presidency and could've filibustered any of his criminal enterprises. Instead, they voted YES on the PATRIOT ACT, “YES” for two illegal wars and subsequent funding, “YES” for Alito, “YES” for Roberts, “YES” for Gonzales, “YES” for Rumself, “YES” to authorize Bush’s spying, “YES” in the Senate (97-0) for the resolution to threaten Iran with force, etc. They are Bush appeasers and co-conspirators. If they were a serious party, Democrats would be investigating real Bush crimes RIGHT NOW, like the reason he invaded Iraq, or the outing of Valerie Plame, or the 'failures' of 911. It'll never happen because Democrats themselves aided and abetted all these crimes. Wake up.

Bring on a war crimes tribunal

robgo2: I respectfully disagree that the American public would not have the stomach for a war crimes tribunal. Americans are angry and want someone to take charge of these war mongers. If we do not make Bush, Cheney, Rumsfeld and the rest of the cronies accountable for their acts, it will happen again down the line. Their crimes fit the punishment of a war crimes tribunal. All of Europe is extremely angry with the US and waiting to see what we are going to do about the most corrupt administration in American history.

The Hague is our only hope.

Don't count on Democrats. Can you actually conceive the idea of a former White House Press Secretary telling the world that a US President went to war for lies and the ‘opposition’ party is doing absolutely NOTHING about it? McClellan will testify, of course, but it'll be just more cheap political theater the way we saw with Gonzales and the firing of the attorneys, which resulted in absolutely nothing. Unless Americans start voting for real leaders like Sheehan, Nader and McKinney, we’ll be stuck in endless wars and desecration of the constitution for decades. Now Obama our beloved preacher is himself nothing more than a war monger in disguise, an Israel appeaser. He voted to keep the funding for the Iraq invasion. Yet, the innocent and foolish are lining up behind this fraud. Good God!
